Terms and Conditions

Welcome to Jaherat Design. By engaging in our services, you agree to abide by the following terms and conditions, which are designed to ensure a clear and mutually beneficial relationship between you, our valued client, and our team. Please read these terms carefully as they form the basis of our agreement.

 

Introduction
At Jaherat Design, we specialize in crafting unique brand identities, websites, and packaging designs that resonate with your target audience. We value transparency, professionalism, and creativity, and strive to deliver exceptional results that align with your brand’s vision.

 

Our Services

We offer a range of services designed to elevate your brand. These include:

  • Branding Packages: From logo design to complete brand identity systems.
  • Web Development: Including both basic and premium website packages with Shopify and WordPress.
  • Packaging Design: Tailored packaging solutions to enhance your product’s appeal.

Payment Terms

To initiate any project, a 60% advance payment is required upon finalizing the deal. The remaining 40% is due upon project completion before the final deliverables are handed over. Payment can be made via Bank Transfer, UPI, PhonePe, Paypal or GPay. Please note that all payments made after the deal is finalized are non-refundable.

 

Project Timelines

Each project has a specific timeline:

  • Branding Package One (Silver): 8-10 days
  • Branding Package Two (Golden): 10-15 days
  • Basic Web Package: 1-2 weeks
  • Premium Web Package: 2-4 weeks
  • Packaging Design: 7-10 days
    We strive to adhere to these timelines, but delays may occur, especially if client communication is delayed.

Revisions and Additional Work

Our branding packages include a specified number of concepts and revisions:

  • Silver Package: 3 concepts, 3 revisions
  • Golden Package: 4 concepts, 4 revisions
  • Packaging Design: 4 concepts, 3 revisions
    Should you require additional options or changes beyond what is included, these will incur additional charges.

 

Advance Payment Requirement

RequirementA 60% advance payment is mandatory upon finalization of the deal.

 

Payment Confirmation Deadline

Failure to confirm the advance payment within 15–20 days of deal finalization will result in automatic cancellation of the deal.

 

Final Design Delivery

Upon finalization of the design, the original file will be released upon receipt of the remaining 50% payment.

 

Certainly Refined Version

We will include the options and modifications outlined in the invoice. Should you require additional options or changes beyond those specified, they will be subject to separate charges.

 

Non-Refundable Payment

All advance payments made after the deal is finalized are non-refundable.

 

Client Communication Delay

In the event of no design updates from the client within a 4–6 week period, the commencement of work will be deferred by 1–2 months.

 

Legal Responsibility

We guarantee that the design is original, authentic, and does not infringe on any existing copyrights or trademarks. We confirm that the logo and branding is unique and complies with trademark regulations (as per country-specific laws), making it eligible for registration. However, we are not responsible for any legal issues arising from misuse or alterations made after delivery of the design.

 

Intellectual Property Rights

Upon full payment, the client will receive the rights to use the final design. However, the designer retains the right to showcase the work in their portfolio or for promotional purposes. (The designer cannot display or make the branding design public until the brand is officially launched.)

 

Design Usage Rights

The client shall not have any rights to use the design until full payment has been made.

 

Brand Name Change Policy

Once a deal is finalized and the brand name is confirmed for logo and branding identity, any change to the brand name during the ongoing work will require the client to purchase a new package. Such changes are not covered under the existing package.

 

Additional File Charges

The original file of the finalized design will be provided. If there is a need to obtain the rejected file, additional charges will apply.

 

Transaction Fees for Clients Outside India

If you are a client based outside India, please be aware that transaction fees (e.g., Bank, PayPal, Wise, etc.) will apply.

 

Client Responsibility for Payment Name Errors

When a client outside India makes a payment, they are responsible for ensuring that the name and spelling are correct. If there is any mistake in the name, our bank may not accept the payment and it could be returned. Any associated fees will be the client’s responsibility.

 

Responsibility Disclaimer

We cannot assume any responsibility until the agreement is signed.

 

Design Authenticity Disclaimer

The designer ensures originality in the design process. However, in case of any unintended resemblance to existing designs, the designer shall not be held legally or financially responsible. Clients are encouraged to conduct their own verification before finalizing the design.

 

Use of Online Design Elements

The designer may use and modify publicly available fonts, colors, and design elements from the internet. The designer is not responsible for any similarities to existing designs, and the client must verify and approve all elements before finalization.

 

Confidentiality

Both parties agree to keep all project-related information confidential and not disclose it to any third party without prior consent.

 

Quotation Validity

This quotation remains valid for a duration of 20 days only.
